1. The service is provided “as is”

Znimai Cloud, the Znimai app for macOS and the znimai.com.ua website (together, the “Service”) are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted or error-free operation, preservation of data, accuracy of text recognition, or compatibility with your hardware.

To the extent permitted by law, [company name] disclaims all warranties not expressly stated in the Terms of Service.

2. Your files and backups

We store files in Amazon Web Services (S3, EU, Frankfurt (Germany) region) with encryption and take reasonable care not to lose them. Still, no storage is guaranteed: hardware failures, software bugs, third-party actions or force majeure can lead to lost or damaged data.

• The Service is a tool for sharing captures, not an archive or a backup. Keep the originals of anything important.
• You can download all your files as one archive at any time from Account → Export.
• Files that expired, that you deleted, or that were deleted with your account cannot be restored.

3. Content you upload

You are responsible for everything you upload and for whom you share links with. We don’t review content in advance and aren’t responsible for users’ files, their legality, accuracy, or the consequences of sharing them.

• Screenshots can contain passwords, personal data or trade secrets. Check what’s in the frame before you share a link.
• Anyone with a public link can view and download the file. For sensitive data use a password, “Only me”, or an expiry date.
• We may restrict or remove content under the Acceptable Use Policy.

4. Availability and changes

We don’t guarantee that the Service will be available all the time, without interruptions or at any particular time. Maintenance, updates, provider outages (hosting, payments, e-mail) and other interruptions can happen. We may change, limit or discontinue features. We’ll give at least 14 days’ notice of material changes to paid plans.

5. Limitation of liability

To the extent permitted by law:

• [company name] is not liable for indirect, incidental, special or consequential damages, lost profits, loss of data, goodwill or revenue, business interruption, or the cost of substitute services — even if advised of the possibility of such damages.
• Our total liability for all claims related to the Service is limited to the amount you actually paid us in the 6 months before the event giving rise to the claim. On the Free plan, it is zero.
• We are not responsible for acts or omissions of third parties: people who received your links, infrastructure providers, banks and payment systems.

These limits don’t apply where the law forbids them (for example, damage caused intentionally, or consumer rights that cannot be waived).

6. Third-party services

Payments are processed by monobank (JSC Universal Bank), e-mail is sent through a mail provider and files are stored by AWS. We don’t control these services and aren’t responsible for their outages, decisions or terms. The full list is on the Subprocessors page.

7. No professional advice

Texts on the website, in the app and from support are for information only and are not legal, tax or technical advice.
